Terms of Service

These Terms govern purchases and use of digital services offered through ZAFORA and delivered by MarketLift Agency.

1. Services and Scope

Service descriptions provide a general overview. Final scope, deliverables, timelines, revision limits, and pricing may also be defined in a proposal, statement of work, order confirmation, or written agreement. If a project-specific agreement conflicts with these Terms, the project-specific agreement controls for that project.

2. Client Responsibilities

You agree to provide accurate information, required content, approvals, and authorized access needed to perform the work. Delays in access, content, approvals, or feedback may affect delivery dates.

3. Account Access and Third-Party Platforms

Some services require authorized access to platforms such as Shopify, Google, Meta, marketplace accounts, hosting, analytics, or other business tools. You are responsible for maintaining ownership of your accounts and complying with third-party platform rules. We do not guarantee approval, ranking, indexing, marketplace acceptance, advertising results, or uninterrupted operation of third-party platforms.

4. Pricing and Payment

Prices may be fixed, starting prices, or custom quotes depending on scope. Work may begin only after required payment, deposit, or written approval is received. Third-party fees and advertising spend are separate unless expressly included.

5. Delivery and Revisions

Digital work is delivered electronically or implemented directly in authorized accounts. Timelines are estimates unless expressly guaranteed in writing. Included revisions are limited to those stated in the service description or project agreement.

6. Cancellations and Refunds

Cancellations and refunds are handled according to our Refund Policy and any project-specific agreement.

7. Intellectual Property

Unless otherwise agreed in writing, upon full payment the client receives rights to final client-specific deliverables created for the project, excluding pre-existing tools, templates, software, methods, licenses, and third-party materials. ZAFORA and MarketLift Agency retain ownership of their pre-existing intellectual property.

8. Acceptable Use

Services may not be used for unlawful, fraudulent, deceptive, infringing, or malicious activity. We may decline or stop work that violates law, third-party platform rules, or these Terms.

9. No Guaranteed Business Results

Marketing, SEO, marketplace, and optimization services are provided using professional judgment and reasonable efforts. Search rankings, platform approvals, traffic, leads, sales, advertising performance, and other business outcomes depend on many factors and are not guaranteed.

10. Third-Party Services

To the extent permitted by law, ZAFORA is not responsible for outages, policy changes, suspensions, delays, data loss, or other actions caused by third-party platforms or services outside our reasonable control.

11. Shopify

This store is powered by Shopify. Purchases are made from ZAFORA, not Shopify. Shopify is not responsible for the digital services provided by ZAFORA or MarketLift Agency.
